These Terms & Conditions (the “Terms”) govern your access to and use of the websites, applications, and services (collectively, the “Services”) operated by Big Blue Whale Corp Ltd(“BBW”, “we”, “us” or “our”), a company registered in England and Wales under company number 14203949 with registered office at 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ. By accessing or using the Services you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility & accounts

You must be at least 18 years old and capable of entering into a legally binding agreement to use the Services. If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

2. The services we provide

BBW publishes information about its products and services and may, from time to time, offer interactive functionality such as enquiry forms, newsletter subscriptions, and access to product demonstrations. Specific products operated by BBW (including but not limited to 12s.in, Estata, Bringo and any other offering listed on this site) may have their own terms of service which apply in addition to these Terms.

3. Acceptable use

You agree not to:

• use the Services in any way that is unlawful, harmful or fraudulent;
• attempt to gain unauthorized access to any portion of the Services, related systems, or networks;
• interfere with or disrupt the integrity, security or performance of the Services;
• reverse engineer, decompile or otherwise attempt to derive the source code of any part of the Services, except to the extent permitted by applicable law;
• use automated means (including scrapers, bots or crawlers) to access the Services in a manner that places undue load on our systems;
• use the Services to send unsolicited communications or to infringe the rights of any third party.

4. Intellectual property

All content on the Services — including text, graphics, logos, icons, images, software and the compilation thereof — is the property of BBW or its licensors and is protected by intellectual-property laws. You may view, download and print content for personal, non-commercial use only, provided that you do not modify the content and retain all copyright and proprietary notices.

“Big Blue Whale”, “BBW”, “12s.in”, “Estata”, “Bringo” and related logos are trademarks of BBW. You may not use them without our prior written permission.

5. User submissions

When you submit information through a contact form, newsletter form or other interactive feature, you grant BBW a non-exclusive, worldwide, royalty-free licence to use that information for the purpose of responding to you and operating the Services. You represent that any information you submit is accurate and that you have the right to submit it.

6. Third-party links

The Services may contain links to third-party websites or services that are not owned or controlled by BBW. We have no control over, and assume no responsibility for, the content, privacy policies or practices of any third-party sites.

7. Disclaimers

The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, BBW disclaims all warranties, express or implied, including the warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure or free of viruses or other harmful components.

8. Limitation of liability

To the maximum extent permitted by law, BBW shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of or in connection with your use of the Services. Our total aggregate liability to you in connection with the Services shall not exceed one hundred British pounds (£100). Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

9. Indemnity

You agree to indemnify and hold harmless BBW, its officers, directors, employees and agents from any claim or demand, including reasonable legal fees, made by any third party arising out of your breach of these Terms or your violation of any law or the rights of a third party.

10. Changes to the services and Terms

We may modify the Services or these Terms at any time. Material changes will be notified by updating the “Last updated” date at the top of this page and, where appropriate, by a notice on the Services. Your continued use of the Services after a change takes effect constitutes acceptance of the revised Terms.

11. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including breach of these Terms. Provisions which by their nature should survive termination (including sections 4, 7, 8, 9 and 12) will continue in effect.

12. Governing law

These Terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these Terms is subject to the exclusive jurisdiction of the courts of England and Wales.
